What we collect from workers
- Your contact details, CV, work history and the work you are looking for.
- Identity and right-to-work evidence, references, and the checks your role needs, such as a driving licence check or, for care roles, an enhanced DBS check, of which we keep only the outcome and dates.
- Your National Insurance number, tax details, bank details, timesheets and, for drivers, the hours you work elsewhere.
- Health information only where you need us to make an adjustment, and only with your agreement.
What we collect from businesses
The names and work contact details of the people we deal with, the details of each role, and payment and credit information about the business.
Why we use it, and our lawful bases
- To find you work and run your assignments: our contract with you.
- To check your right to work, pay you through PAYE, enrol you in a pension, keep working-time and drivers' hours records and the records the Conduct of Employment Agencies and Employment Businesses Regulations 2003 require: legal obligations.
- To run and improve our service and deal with businesses: our legitimate interests.
- Criminal record check outcomes and any health information: the employment conditions of the Data Protection Act 2018, under our appropriate policy document.
A person makes every placement decision; no decision about you is made solely by a computer.
Who we share it with
A business, only with your agreement for that job, and right-to-work evidence only as a confirmation of the check. HMRC, our pension provider, the Disclosure and Barring Service, the Home Office and our identity-check provider where the law or your checks require it. Our service providers, who process it for us under contract: Google (email), Cloudflare (website), Supabase and Amazon Web Services (database and storage, in the UK and EU).
How long we keep it
- Records the Conduct Regulations require: at least one year after the last service we provided to you.
- Right-to-work check copies: for your work with us and two years after.
- Working-time and drivers' hours records: two years.
- Payroll and tax records: six years after the end of the tax year they relate to.
Your rights
You can ask for a copy of your information, and ask us to correct it, delete it, limit how we use it, or give it to you in a portable form. You can object to our use of it based on legitimate interests. We reply within one month. You can also complain to the Information Commissioner's Office: ico.org.uk/make-a-complaint, or 0303 123 1113.
